Welcome to Tenacity Sportswear! These Terms of Service ("Terms") govern your access to and use of the Tenacity Sportswear website www.tenacitysportswear.co.uk and any related services, including online purchases, social media platforms, and mobile applications (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.  

By using the Services, you represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

• Product Information: We strive to provide accurate and up-to-date information regarding our products, including descriptions, pricing, and availability. However, we do not warrant that product descriptions or other content on the Services are accurate, complete, reliable, current, or error-free.  

• Order Acceptance: Your order constitutes an offer to purchase our products. We reserve the right to accept or decline your order for any reason, including but not limited to, product availability, errors in pricing or product information, or suspicion of fraud.  

• Pricing and Payment: All prices are in BGP (£) and are subject to change without notice. Payment must be received before your order is processed. We accept Card Payments and in some cases Apple Pay or Google Pay.

• Shipping and Delivery: Shipping and delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events beyond our control. Risk of loss and title for products purchased from us pass to you upon delivery to the carrier.  

• Returns and Exchanges: Our returns and exchanges policy is available on our website www.tenacitysportswear.co.uk/delivery-returns. Please review this policy carefully before making a purchase.

• Account Creation: You may be required to create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account information and password.

• Account Responsibility: You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorised access to or use of your account.  

• Account Termination: We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to, violation of these Terms.

• User Content: You may be able to submit content to the Services, such as reviews, comments, or photos ("User Content"). You retain ownership of your User Content.

• License to User Content: By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.  

• User Content Guidelines: You agree not to submit User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

• Ownership: The Services and all content, including but not limited to, text, graphics, logos, images, and software, are the property of Tenacity Sportswear or its licensors and are protected by intellectual property laws.

• Limited License: We grant you a limited, non-exclusive, and non-transferable license to access and use the Services for personal, non-commercial purposes.  

• Restrictions: You may not reproduce, modify, distribute, or create derivative works from any content on the Services without our express written permission.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TENACITY SPORTSWEAR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL TENACITY SPORTSWEAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

You agree to indemnify and hold Tenacity Sportswear and its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, and expenses (including attorneys' fees) arising out of or in connection with your use of the Services or your violation of these Terms. 

These Terms shall be governed by and construed in accordance with the laws of The United Kingdom, without regard to its conflict of law principles.

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Services and update the "Last Updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
